Our mission with EagleHub is to create a central online social community for like-hearted, like-minded believers and followers of Jesus Christ. Our services are designed to allow the body of Christ to connect, share, learn, and grow together in their walk with Jesus by sharing the Gospel and adhering to Biblical principles.

 

PLEASE READ THESE TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THIS WEBSITE

 

When you use and browse this website you are agreeing to comply with and be bound by the following terms and conditions of use, as well as our Privacy Policy and Community Guidelines, which govern eaglehub.com.au’s relationship with you in relation to your use of our Services including this website and our EagleHub app.

By using our Services including our website and app, you signify your acceptance of these terms and conditions of use. For the purposes of these terms and conditions, “Us”, “Our” and “We” refers to eaglehub.com.au, EagleHub, Bold Existence Pty Ltd (‘together Bold Existence’) and “You” and “Your” refers to you, the customer, visitor, website user or person using our website. Eaglehub.com.au is owned by Bold Existence Pty Ltd.

You agree that by clicking “Join Now”, “Join the EagleHub”, “Join the Eagles”, “Sign Up” or similar, registering, accessing or using our services (described below), you are agreeing to enter into a legally binding contract with Bold Existence. If you do not agree to this contract (“Contract” or “Terms and Conditions”), do not click “Join Now” (or similar) and do not access or otherwise use any of our Services. If you wish to terminate this contract, at any time you can do so by closing your account and no longer accessing or using our Services.

This Contract applies to eaglehub.com.au, and EagleHub app, and other Bold Existence-related sites, apps, communications and other services that state that they are offered under this Contract (“Services”). Registered users of our Services are “Members” and “Affiliates” unregistered users are “Visitors”.

 

YOUR PROMISE AND COMMITMENT TO US

 

Registration

When you register an account with us at eaglehub.com.au, you agree to use your real name and email during account sign up. Basic Members and Premium Members are account holders. You agree that you will not create a false identity on eaglehub.com.au, misrepresent your identity, create a Member profile for anyone other than yourself (a real person), or use or attempt to use or impersonate another’s account. You also agree that you have not already been restricted by eaglehub.com.au and Bold Existence from using the Services. Creating an account with false information is a violation of our terms, including accounts registered on behalf of others or persons under the age of 18. If we suspect an account has been created with a false identity, we reserve the right to terminate the account immediately. You agree that you will use a strong password and keep it confidential and that you will not transfer any part of your account (e.g., connections) and follow the law and our Community Guidelines. You are responsible for anything that happens through your account unless you close it or report misuse on your account. Your account belongs to you.

Notices and messages

When you sign up to our Services you agree that we will provide notices and messages to you within the Service, or sent to the contact information you provided us (e.g., email). You agree to keep your contact information up to date. You update your contact information in your account settings, or by emailing us at support@eaglehub.com.au. You can control and limit the messages you receive from us by enabling or disabling them in your notification settings of your EagleHub profile.

Sharing of information

You agree that when you share information on our Services, others can see, copy and use that information. Our Services allow messaging and sharing of information in many ways, such as your profile, group posts, links to other articles or videos, discussion forums and messages. Information and content that you share or post may be seen by other Members (“Members”) or others (including off of the Services). Where we have made settings available, we will honor the choices you make about who can see your content or information. We are not obligated to publish any information or content on our Service and can remove it with or without notice. You own all of the content, feedback and personal information you provide to us, but you also grant us a non-exclusive license to it. Because you own your content and information and we only have non-exclusive rights to it, you may choose to make it available to others. You promise to only provide information and content that you have the right to share, and that your EagleHub profile will be truthful. You agree to only provide content or information that does not violate the law nor anyone’s rights (including intellectual property rights). Bold Existence may be required by law to remove certain information or content in certain countries.

Use and storage of information

You and Bold Existence agree that we may access, store, process and use any information and personal data that you provide in accordance with, the terms of the Privacy Policy and your choices (including settings). By submitting suggestions or other feedback regarding our Services to Bold Existence, you agree that Bold Existence can use and share (but does not have to) such feedback for any purpose without compensation to you.

Using others’ content

Your use of others’ content and information posted on our Services, is at your own risk. Others may offer their own products and services through our Services, and we aren’t responsible for those third-party activities. You agree that you will not violate the intellectual property rights of others, including copyrights, patents, trademarks, trade secrets or other proprietary rights. For example, do not copy or distribute (except through the available sharing functionality) the courses, eLearning materials, blogs, posts or other content of others without their permission, which they may give by posting under a Creative Commons license. By using the Services, you may encounter content or information that might be inaccurate, incomplete, delayed, misleading, illegal, offensive or otherwise harmful. Bold Existence generally does not review content provided by our Members or others. You agree that we are not responsible for others’ (including other Members’) content or information. We cannot always prevent this misuse of our Services, and you agree that we are not responsible for any such misuse.

Courses, eLearning, groups and blogs

Premium Members have access to create courses, groups and other eLearning materials and share links to their own websites inside EagleHub.  As a Premium Member you agree that you create courses, eLearning materials, groups and blogs at your own risk. You agree that Bold Existence will not be held liable for any losses or damages incurred in the event of anyone copying or distributing your created content. You agree that Bold Existence is also not responsible for the storage of your created content or for keeping back-ups of your content outside of our regular Server back-ups of our Website. When you create content (e.g., courses, eLearning materials, groups) inside EagleHub, you agree and acknowledge that only Basic Members and Premium Members in EagleHub will be able to sign up and access your content. You agree that the content you create inside EagleHub will not be accessible to unregistered users (e.g., Visitors, search engines, other social media platforms). You also agree and acknowledge that if a Member should purchase any of your course content and eLearning materials and the Member discontinues their EagleHub Membership, they will lose all access to their course content and will not be able to access it outside of EagleHub. If the Member wishes to continue in their course, they will need to re-register as a Member of EagleHub or sign up at your own website. You agree that Bold Existence will not be held liable for any losses, damages or misinformation incurred by the courses, eLearning materials, events or groups you create in the EagleHub.

All course content, eLearning materials, group content and event content you create belongs to you. You agree that you are personally responsible for the accuracy of the information and content you provide. You agree that Bold Existence will not be held liable for any disputes that may arise between you and a Member regarding the content you provide. You (Premium Member) agree that you will not share, sell, advertise, spam or misuse Members email addresses when they sign up to your courses and eLearning materials. You agree that you may only use Members’ email addresses who are enrolled in your courses and eLearning materials to notify and contact them regarding their enrolled courses and eLearning materials (e.g., in relation to assignments, quizzes, group discussions, course related questions). Any use of Members’ email addresses outside of courses and eLearning material related content is a violation in Privacy Policy and confidentiality. You agree Bold Existence will not be held liable or incur any losses if you violate the terms of this agreement and Privacy Policy. You (Premium Member) agree to not sell, spam, misuse, or share email addresses and names of Members who signed up to your courses and eLearning materials.

You (Basic Member) agree that when you purchase, sign-up and use the courses, eLearning materials, groups and events on eaglehub.com.au created by Premium Members, that you do so at your own risk. You (Basic Member) also agree that your email address and name will be visible to Premium Members of related courses and eLearning materials you enrol in. You agree that Bold Existence will not be held liable in the event of your email address being misused by such Premium Members. You (Basic Member) agree that if you do not wish for Premium Members to have access to your email address and name, that you will not sign up to their course or eLearning material. You agree that Bold Existence will not be held responsible if Premium Members violate the terms of this contract and misuse your email address and name. You agree that you provide your email address and name at your own discretion.

Limitations of Service

Bold Existence reserves the right to limit your use of the Services, including the number of your connections and your ability to contact other Members. Bold Existence reserves the right to restrict, suspend, or terminate your account if you breach this Contract or the law or are misusing the Services (e.g., violating any of the Community Guidelines). You agree that you will comply with all applicable laws, including, without limitation, privacy laws, intellectual property laws, anti-spam laws, export control laws, tax laws, and regulatory requirements; provide accurate information to us and keep it updated; use your real name on your profile; and use the Services in a respectful manner.

Other

You agree to not develop, support or use software, devices, scripts, robots or any other means or processes (including crawlers, browser plugins and add-ons or any other technology) to scrape the Services or otherwise copy profiles and other data from the Services; override any security feature or bypass or circumvent any access controls or use limits of the Service; post anything that contains software viruses, worms, or any other harmful code; Reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code for the Services or any related technology that is not open source; imply or state that you are affiliated with or endorsed by Bold Existence without our express consent (e.g., representing yourself as an accredited Bold Existence instructor); rent, lease, loan, trade, sell/re-sell or otherwise monetize the Services or related data or access to the same, without Bold Existence’s consent; use bots or other automated methods to access the Services, add or download contacts, send or redirect messages; monitor the Services’ availability, performance or functionality for any competitive purpose; engage in “framing,” “mirroring,” or otherwise simulating the appearance or function of the Services; overlay or otherwise modify the Services or their appearance (such as by inserting elements into the Services or removing, covering, or obscuring an advertisement included on the Services); Interfere with the operation of, or place an unreasonable load on, the Services (e.g., spam, denial of service attack, viruses, gaming algorithms); and/or violate the Community Guidelines or any additional terms concerning a specific Service that are provided when you sign up for or start using such Service.

You take full responsibility and risk for making any decision based on information on our website or in using our Services. You hereby agree to irrevocably release and waive any claims you may have now or in the future against us and we take no responsibility or liability whatsoever for any loss, damage or injury that may arise from any person acting on any statement or information contained on this website and all such liabilities are expressly disclaimed.

The information and any recommendations and advice contained on or through this website is for general information purposes only and is not meant to substitute individual personal and professional advice or application. Any advice, information and recommendations are to be used at your discretion.

 

PAYMENT AND REFUNDS

 

We try to ensure our services are provided with due care and skill, and we at all times abide by the Australian Consumer Protection legislation with respect to any refund. Any other refund is done in accordance with our refund policy and in our sole discretion (*see below). All fees are non-refundable and are non-transferrable between products or services unless, during the period in which you paid for a product or service through this website or our app, the product or service was not available. In this circumstance, a refund may be granted upon written request by email at support@eaglehub.com.au, however, you acknowledge that we may refuse a request where we are able to provide the product or service to you through alternative means (such as email).

Courses and eLearning materials that are available within EagleHub, require an active “Basic Membership” or “Premium Membership” subscription. When you purchase courses and eLearning materials within EagleHub, these will remain accessible to you for the duration of your active “Basic Membership” or “Premium Membership” subscription. If you cancel your “Basic Membership” or “Premium Membership” subscription, you will lose all access to courses and eLearning materials you purchased within EagleHub. Refunds will not be issued for courses and eLearning materials purchased if you decide to discontinue your “Basic Membership” or “Premium Membership” subscription. The courses and eLearning materials within EagleHub are part of the Services we provide at eaglehub.com.au.

Acceptance and continued access to our services and products are always subject to payment first being made by you. We make use of STRIPE and PayPal payment gateways. By using our services you agree that we will not be held liable for any loss you incur arising from your use of these payment methods unless caused by our fraud or the fraud of our employees.

If you buy any of our paid Services, you agree to pay us the applicable fees and taxes specific to the paid Services. Failure to pay these fees will result in the termination of your paid Services. Also, you agree that your purchase may be subject to foreign exchange fees or differences in prices based on location (e.g. exchange rates). We may store and continue billing your payment method (e.g. credit card) even after it has expired, to avoid interruptions in your Services and to use to pay other Services you may buy. If you purchase a subscription, your payment method automatically will be charged at the start of each subscription period for the fees and taxes applicable to that period. To avoid future charges, cancel before the renewal date. You can cancel your subscription from your account settings or by emailing us at support@eaglehub.com.au.

 

*Available Refunds

We offer a thirty-day-money back guarantee for first-time sign-ups to “Basic Membership” and “Premium Membership”. If within thirty days of initial sign up you decide to discontinue our Services at eaglehub.com.au, you may receive a full refund on your “Basic Membership” or “Premium Membership” subscription by emailing us a refund request at support@eaglehub.com.au. You will need to provide your original sign-up email, username and name, for us to track your subscription and issue your refund and cancel your subscription. If you decide to discontinue our Services at eaglehub.com.au after 30 days of initial sign-up, you will not be issued a refund, and your subscription will be cancelled. In the event of you cancelling your subscription and later decide to sign up again, you will not receive a refund. The thirty-day money-back guarantee is for first-time sign-ups only, which allows customers to use our Services to see if our Services are the right fit for them. Please note, if you purchase any courses or eLearning materials during your initial thirty-day sign-up period and decide to discontinue our Services, you will lose access to those courses and eLearning materials and will not receive a refund on purchases made for courses and eLearning materials. You will not be able to access any courses or eLearning materials outside of an active “Basic Membership” or “Premium Membership” subscription.

 

Premium Membership and Business Membership course and eLearning payments

When you (Premium Membership or Business Membership only) create courses and eLearning materials on our EagleHub platform you reserve the right to make your courses and eLearning materials available for free or available for purchase/donation via placing a donation link (to your website) inside the course/materials you create on EagleHub. You agree that we are not responsible and will not be held liable for any payments, payouts, issuing any invoices or refunds for any such donations or purchases made to you through your links on your courses. You also agree that if members purchase or donate to your course or eLearning material and they cancel their 'Basic Membership', 'Premium Membership' or 'Business Membership' with us, they will lose access to these and we will not be held liable for any losses in that regard. It is at your sole responsibility to deliver your own purchase and donation terms and conditions. Any links used diverting away from EagleHub to make purchases are not our responsibility.  When you make your courses and eLearning materials available for purchase or donation you agree that if a customer should ask for a refund for your course or eLearning material you are responsible for all such refunds. You agree that we will not be held liable for any financial losses you may incur with regards to asking for donations or purchases for your courses and eLearning materials on EagleHub.

 

Our Basic Membership

 

When you sign up for our 'Basic Membership' subscription, you receive full access to EagleHub, including being able to join courses, events and groups. However, our 'Basic Membership' does not allow you to create your own groups, courses or events. You will need to upgrade to our 'Premium Membership' if you wish to create these. When you sign up for our 'Basic Membership', you are allowed to post content on EagleHub as outlined in the terms of this page (Terms of Service) and our Community Guidelines. However, with our 'Basic Membership', you are not permitted to links to your own websites, courses, products, services or social media. If you wish to post links to your own websites, courses, social media and products, you will need to upgrade your membership to our 'Premium Membership' subscription.

 

Content you are permitted to post in EagleHub:

• Links to videos, songs, blogs, websites and social media that are not your own that you wish to share with others, and making sure you state as not your own content.
• Your own songs, lyrics, words, thoughts, prayers, viewpoints, discussions, comments, Bible scriptures, poetry and writing.
• Content that is permitted in accordance with the rest of the terms outlined on this page (Terms of Service) including our Community Guidelines

 

Content you are not permitted to post:

• Links to videos, blogs, websites, services, products that are your own.
• Advertisement and promotional content to your own website, products and services
• Content asking EagleHub members to like, subscribe or follow you on your social media pages.
• Content exploiting EagleHub members for money.
• Content that is not permitted in accordance with the rest of the terms outlined on this page (Terms of Service) including our Community Guidelines.

 

Our Premium Membership

 

When you sign up for our 'Premium Membership' subscription, you receive full access to EagleHub, including being able to join courses, events and groups. Your 'Premium Membership' also allows you to create your own groups, courses or events so that Members in EagleHub can access and engage with your content.

You are allowed to post content on EagleHub as outlined in the terms of this page (Terms of Service) and our Community Guidelines. Premium Membership is designed for Members who want to contribute more actively within the EagleHub community through creating Christ-centred content, groups, courses, discussions and events.

Premium Members are permitted to share their own Christian, ministry-related and faith-based content within EagleHub in accordance with these Terms of Service and Community Guidelines. Business advertising, product promotion, sales, service-related marketing and “Helpful Product” groups are reserved for Business Members only.

 

Content you are permitted to post in EagleHub:

• Links to videos, songs, blogs and websites that are not your own content that you wish to share with others, while clearly stating they are not your own content.
• Links to your own Christian, ministry-related and faith-based content, including blogs, devotionals, teachings and resources.
• Your own songs, lyrics, prophetic words, devotionals, thoughts, prayers, viewpoints, discussions, comments, Bible scriptures, poetry, writings and blogs uploaded directly to EagleHub or shared via your own links.
• Content that encourages, equips or helps other believers grow in faith and aligns with our Terms of Service and Community Guidelines.
• Content asking EagleHub Members to like, subscribe or follow your Christian or ministry-related social media pages, provided the content aligns with our Terms of Service and Community Guidelines.
• Content that is permitted in accordance with the rest of the terms outlined on this page (Terms of Service), including our Community Guidelines.

 

Content you are not permitted to post:

• Business advertisements, promotional sales content, product marketing or service-related promotions unless you are subscribed to our “Business Membership”.
• Products, services or promotional offers outside of approved “Helpful Product” groups available to Business Members only.
• Content exploiting EagleHub Members for money.
• Content that is not permitted in accordance with the rest of the terms outlined on this page (Terms of Service), including our Community Guidelines.

 

Our Business Membership

When you sign up for our “Business Membership” subscription, you receive all access included within our “Basic Membership” and “Premium Membership” subscriptions, together with access to designated business-related features inside EagleHub.

Our “Business Membership” allows Members to:

• Participate in the private EagleHub business community spaces and groups.
• Connect with other Christian entrepreneurs, business owners, ministry leaders and professionals.
• Create and manage “Helpful Product” groups in accordance with these Terms of Service and Community Guidelines.
• Submit their business, ministry, product or service details to be displayed within the EagleHub Online Christian Business Directory.
• Share products, services, offers and promotions only within approved “Helpful Product” groups created by them and joined voluntarily by Members.

When using our “Business Membership” features, you agree that all business-related interactions, promotions, products, services and communications must remain respectful, Christ-centred, lawful and aligned with the values and purpose of EagleHub.

You agree that EagleHub is not a marketplace, lead generation platform, advertising platform, nor sales platform. The purpose of business-related features inside EagleHub is to allow faith-aligned connection, encouragement, collaboration and visibility between Members.

You agree that:

• Business promotions, products, services, offers and advertisements are not permitted within the main EagleHub news-feed.
• You may not privately message Members regarding your products, services, offers, business or promotions unless the Member has voluntarily joined your “Helpful Product” group or otherwise explicitly requested communication from you.
• You must immediately honour any request from a Member asking not to receive further business-related communication, promotions or messages from you.
• You may not harvest, export, copy, misuse or distribute Member information, contact details or personal information for marketing purposes.
• You may not pressure, manipulate, repeatedly solicit or exploit Members financially.
• You are solely responsible for the products, services, advice, promotions, offers and business-related content you provide.
• Bold Existence reserves the right to remove, restrict, suspend or terminate any business-related content, group, listing or Member account that violates these Terms of Service or Community Guidelines.

 

Advertisement and Promotion Terms

 

EagleHub is a Christ-centred community platform designed to help believers grow in faith, connection, life and calling. EagleHub is not a marketplace, advertising platform or sales platform.

All advertisement, promotion, courses, groups, events, products, services and content shared inside EagleHub must align with the purpose and values of the community, remain respectful and Christ-centred, and exist to help, encourage or support others in a genuine and meaningful way.

What can be advertised and promoted in EagleHub:

When you (Premium Members and Business Members) create a new course, group or event inside EagleHub, you may post a notification in the main News-Feed to inform other EagleHub Members that it is available to access.

Business advertisements, promotions, products, services and sales are only permitted for active Business Members within approved “Helpful Product” groups created by them.

Business Members are permitted to:

• Create “Helpful Product” groups.
  Share products, services, offers and promotions within their approved “Helpful Product” groups.
• Post links to their own websites, products and services within their approved “Helpful Product” groups.
  Notify Members who voluntarily joined their “Helpful Product” group about products, services, updates and promotions related to that group.
• Business-related content, products, services and promotions must remain aligned with the purpose and values of EagleHub and must not become excessive, manipulative, misleading or exploitative.

Premium Members are permitted to share Christian, ministry-related and faith-based content, including courses, blogs, devotionals, teachings and social media content, provided the content aligns with these Terms of Service and Community Guidelines. Premium Members are not permitted to advertise products, services or sales unless subscribed to the Business Membership.

What is not permitted:

• Business promotions, products, services, advertisements or sales posts in the main EagleHub News-Feed.
• Privately messaging Members regarding products, services, promotions, sales or business-related content unless the Member has voluntarily joined your “Helpful Product” group or otherwise explicitly requested communication from you.
• Sending repeated unsolicited business or promotional messages to Members.
  Content that is self-focused and not intended to encourage, help or support others in faith and growth.
• Content that is competitive, manipulative or exploitative in nature.
  Content designed primarily to gain followers, subscribers, customers or sales rather than contribute meaningfully to the community.
• Content containing false urgency or pressure tactics.
• Any misuse of Member information, contact details or personal information for marketing or solicitation purposes.
• If a Member asks not to receive further promotions, sales or business-related communication from you, you agree to honour that request immediately.

Bold Existence reserves the right to remove, restrict, suspend or terminate any content, group, listing or Member account that violates these Terms of Service, Community Guidelines or the purpose and values of EagleHub.

Online Christian Business Directory

• EagleHub may provide an Online Christian Business Directory where Business Members may voluntarily submit and display their business, ministry, product or service information publicly.
• By submitting your business or ministry details to the EagleHub Online Christian Business Directory, you agree that: You are solely responsible for the accuracy, legality and legitimacy of the information you provide.
• You have all necessary rights, permissions and authority to display and promote your business, ministry, products or services.
• Your listing and business-related content must comply with all applicable laws and regulations.
• Your listing may be edited, declined, suspended or removed by Bold Existence at our sole discretion and without notice.

Bold Existence, EagleHub and eaglehub.com.au do not endorse, verify, investigate, guarantee or warrant any businesses, ministries, products or services listed within the directory.

Members and Visitors acknowledge and agree that:

• Any engagement, communication, transaction, purchase or reliance upon any listed business, ministry, product or service is entirely at their own discretion and risk.
• Bold Existence will not be held liable for any loss, damage, dispute, injury, dissatisfaction, claim, misconduct, negligence or issue arising from any interaction with businesses, ministries or persons listed within the directory.
• The Online Christian Business Directory is provided for informational and community connection purposes only and should not be interpreted as endorsement, accreditation, recommendation or approval by Bold Existence or EagleHub.

 

Terms for signing up to our Affiliate program

 

Your participation in our Affiliate Program is solely to legally advertise our website to receive a commission on memberships and products purchased by individuals referred to EagleHub by your own website or personal referrals.

By signing up for the EagleHub Affiliate Program (Program), you indicate your acceptance of this Agreement and its terms and conditions.

1. Approval or Rejection of the Application
We reserve the right to approve or reject ANY Affiliate Program Application in our sole and absolute discretion. You will have no legal recourse against us for the rejection of your Affiliate Program Application.

2. Commissions
Commissions will be paid once a month. For an Affiliate to receive a commission, the referred account must remain active for a minimum of 37 days.

You cannot refer yourself, and you will not receive a commission on your own accounts. There is also a limit of one commission per referral. If someone clicks the link on your site and orders multiple accounts, then you will receive a commission on the first order only.

Payments will only be sent for transactions that have been successfully completed. Transactions that result in chargebacks or refunds will not be paid out.

3. Termination
Your affiliate application and status in the Program may be suspended or terminated for any of the following reasons:

Inappropriate advertisements (false claims, misleading hyperlinks, etc.).
Spamming (mass email, mass newsgroup posting, etc.).
Advertising on sites containing or promoting illegal activities.
Failure to disclose the affiliate relationship for any promotion that qualifies as an endorsement under existing Federal Trade Commission guidelines and regulations, or any applicable state laws.
Violation of intellectual property rights. EagleHub reserves the right to require license agreements from those who employ trademarks of EagleHub in order to protect our intellectual property rights.
Offering rebates, coupons, or other form of promised kick-backs from your affiliate commission as an incentive. Self referrals, fraudulent transactions, suspected Affiliate fraud.
In addition to the foregoing, EagleHub reserves the right to terminate any Affiliate account at any time, for any violations of this Agreement or no reason.

4. Affiliate Links
You may use graphic and text links both on your website and within in your email messages and social media.

You may use the graphics and text provided by us, or you may create your own as long as they are deemed appropriate according to the conditions and not in violation as outlined in Condition 3.

5. Coupon and Deal Sites
EagleHub occasionally offers coupons to select affiliates and subscribers. If you’re not pre-approved / assigned a branded coupon, then you’re not allowed to promote the coupon. Below are the terms that apply for any affiliate who is considering the promotion of our products in relation to a deal or coupon:

Affiliates may not use misleading text on affiliate links, buttons or images to imply that anything besides currently authorized deals to the specific affiliate.
Affiliates may not bid on EagleHub Coupons, EagleHub Discounts or other phrases implying coupons are available.
Affiliates may not generate pop-ups, pop-unders, iframes, frames, or any other seen or unseen actions that set affiliate cookies unless the user has expressed a clear and explicit interest in activating a specific savings by clicking on a clearly marked link, button or image for that particular coupon or deal. Your link must send the visitor to the merchant site.
User must be able to see coupon/deal/savings information and details before an affiliate cookie is set (i.e. “click here to see coupons and open a window to merchant site” is NOT allowed).
Affiliate sites may not have “Click for (or to see) Deal/Coupon” or any variation, when there are no coupons or deals available, and the click opens the merchant site or sets a cookie. Affiliates with such text on the merchant landing page will be removed from the program immediately.
6. Pay Per Click (PPC) Policy
PPC bidding is NOT allowed without prior written permission.

7. Liability
EagleHub will not be liable for indirect or accidental damages (loss of revenue, commissions) due to affiliate tracking failures, loss of database files, or any results of intents of harm to the Program and/or to our website(s).

We do not make any expressed or implied warranties with respect to the Program and/or the memberships or products sold by EagleHub. We make no claim that the operation of the Program and/or our website(s) will be error-free and we will not be liable for any interruptions or errors.

8. Term of the Agreement
The term of this Agreement begins upon your acceptance in the Program and will end when your Affiliate account is terminated.

The terms and conditions of this agreement may be modified by us at any time. If any modification to the terms and conditions of this Agreement are unacceptable to you, your only choice is to terminate your Affiliate account. Your continuing participation in the Program will constitute your acceptance of any change.

9. Indemnification
Affiliate shall indemnify and hold harmless EagleHub and its affiliate and subsidiary companies, officers, directors, employees, licensees, successors and assigns, including those licensed or authorized by EagleHub to transmit and distribute materials, from any and all liabilities, damages, fines, judgments, claims, costs, losses, and expenses (including reasonable legal fees and costs) arising out of or related to any and all claims sustained in connection with this Agreement due to the negligence, misrepresentation, failure to disclose, or intentional misconduct of Affiliate.

10. Governing Law, Jurisdiction, and Attorney Fees
This Agreement shall be governed by and construed in accordance with The laws of Australia. Any dispute arising under or related in any way to this Agreement shall be adjudicated exclusively in the state courts located in New South Wales.

In the event of litigation to enforce any provision of this Agreement, the prevailing party will be entitled to recover from the other party its costs and fees, including reasonable legal fees.

11. Electronic Signatures Effective
The Agreement is an electronic contract that sets out the legally binding terms of your participation in the EagleHub affiliate program. You indicate your acceptance of this Agreement and all of the terms and conditions contained or referenced in this Agreement by completing the EagleHub application process. This action creates an electronic signature that has the same legal force and effect as a handwritten signature.

 

 

COMPETITION AND CONSUMER ACT

 

For the purposes of Schedule 2 of the Australian Consumer Law, in particular Sections 51 to 53, 64 and 64A of Part 3-2, Division 1, Subdivision A of the Competition and Consumer Act 2010 (Cth), Boldexistence’s liability for any breach of a term of this agreement is limited to: the supplying of the goods or services to you again; the replacement of the goods; or the payment of the cost of having the goods or services supplied to you again.

It is an essential pre-condition to you using our website that you agree and accept that Bold Existence is not legally responsible for any loss or damage you might suffer related to your use of the website, whether from errors or from omissions in our documents or information, any goods or services we may offer or from any other use of the website. This includes your use or reliance on any third party content, links, comments, courses, eLearning materials or advertisements. COMPLAINTS REGARDING CONTENT

 

We respect the intellectual property rights of others. We require that information posted by Members be accurate and not in violation of the intellectual property rights or other rights of third parties. WHOLE AGREEMENT
