By using our Services including our website and app, you signify your acceptance of these terms and conditions of use. For the purposes of these terms and conditions, “Us”, “Our” and “We” refers to eaglehub.com.au, EagleHub, Bold Existence Pty Ltd (‘together Bold Existence’) and “You” and “Your” refers to you, the customer, visitor, website user or person using our website. Eaglehub.com.au is owned by Bold Existence Pty Ltd.
You agree that by clicking “Join Now”, “Join the EagleHub”, “Join the Eagles”, “Sign Up” or similar, registering, accessing or using our services (described below), you are agreeing to enter into a legally binding contract with Bold Existence. If you do not agree to this contract (“Contract” or “Terms and Conditions”), do not click “Join Now” (or similar) and do not access or otherwise use any of our Services. If you wish to terminate this contract, at any time you can do so by closing your account and no longer accessing or using our Services.
This Contract applies to eaglehub.com.au, and EagleHub app, and other Bold Existence-related sites, apps, communications and other services that state that they are offered under this Contract (“Services”). Registered users of our Services are “Members” and “Ambassadors” unregistered users are “Visitors”.
YOUR PROMISE AND COMMITMENT TO US
Registration
When you register an account with us at eaglehub.com.au, you agree to use your real name and email during account sign up. Members and Ambassadors are account holders. You agree that you will not create a false identity on eaglehub.com.au, misrepresent your identity, create a Member profile for anyone other than yourself (a real person), or use or attempt to use or impersonate another’s account. You also agree that you have not already been restricted by eaglehub.com.au and Bold Existence from using the Services. Creating an account with false information is a violation of our terms, including accounts registered on behalf of others or persons under the age of 18. You agree that you will use a strong password and keep it confidential and that you will not transfer any part of your account (e.g., connections) and follow the law and our Community Guidelines. You are responsible for anything that happens through your account unless you close it or report misuse on your account. Your account belongs to you.
Notices and messages
When you sign up to our Services you agree that we will provide notices and messages to you within the Service, or sent to the contact information you provided us (e.g., email). You agree to keep your contact information up to date. You update your contact information in your account settings, or by emailing us at [email protected]. You can control and limit the messages you receive from us by enabling or disabling them in your notification settings of your EagleHub profile.
Sharing of information
You agree that when you share information on our Services, others can see, copy and use that information. Our Services allow messaging and sharing of information in many ways, such as your profile, group posts, links to other articles or videos, discussion forums and messages. Information and content that you share or post may be seen by other Members (“Members” and “Ambassadors”) or others (including off of the Services). Where we have made settings available, we will honor the choices you make about who can see your content or information. We are not obligated to publish any information or content on our Service and can remove it with or without notice. You own all of the content, feedback and personal information you provide to us, but you also grant us a non-exclusive license to it. Because you own your content and information and we only have non-exclusive rights to it, you may choose to make it available to others. You promise to only provide information and content that you have the right to share, and that your EagleHub profile will be truthful. You agree to only provide content or information that does not violate the law nor anyone’s rights (including intellectual property rights. Bold Existence may be required by law to remove certain information or content in certain countries.
Use and storage of information
You and Bold Existence agree that we may access, store, process and use any information and personal data that you provide in accordance with, the terms of the Privacy Policy and your choices (including settings). By submitting suggestions or other feedback regarding our Services to Bold Existence, you agree that Bold Existence can use and share (but does not have to) such feedback for any purpose without compensation to you.
Using others’ content
Your use of others’ content and information posted on our Services, is at your own risk. Others may offer their own products and services through our Services, and we aren’t responsible for those third-party activities. You agree that you will not violate the intellectual property rights of others, including copyrights, patents, trademarks, trade secrets or other proprietary rights. For example, do not copy or distribute (except through the available sharing functionality) the courses, eLearning materials, blogs, posts or other content of others without their permission, which they may give by posting under a Creative Commons license. By using the Services, you may encounter content or information that might be inaccurate, incomplete, delayed, misleading, illegal, offensive or otherwise harmful. Bold Existence generally does not review content provided by our Members or others. You agree that we are not responsible for others’ (including other Members’ and Ambassadors’) content or information. We cannot always prevent this misuse of our Services, and you agree that we are not responsible for any such misuse.
Courses, eLearning, groups and blogs
Ambassadors are Members who have access to create courses, groups, other eLearning materials and blogs inside EagleHub. Ambassador status is obtained by our sole discretion. We reserve the right to deny Ambassador status and limit Ambassador registrations. As an Ambassador you agree that you create courses, eLearning materials, groups and blogs at your own risk. You agree that Bold Existence will not be held liable for any losses or damages incurred in the event of anyone copying or distributing your created content. You agree that Bold Existence is also not responsible for the storage of your created content or for keeping back-ups of your content outside of our regular Server back-ups of our Website. When you create content (e.g., courses, eLearning materials, blogs) inside the EagleHub, you agree and acknowledge that only Members and other Ambassadors in the EagleHub will be able to sign up and access your content. You agree that the content you create inside the EagleHub will not be accessible to unregistered users (e.g., Visitors, search engines, other social media platforms). You also agree and acknowledge that if a Member should purchase any of your course content and eLearning materials and the Member discontinues their EagleHub Membership, they will lose all access to their course content and will not be able to access it outside of the EagleHub. If the Member wishes to continue in their course, they will need to re-register as a Member of EagleHub. You agree that Bold Existence will not be held liable for any losses, damages or misinformation incurred by the courses, eLearning materials, blogs or groups you create in the EagleHub.
All course content, eLearning materials, group content and blog content you create belongs to you. You agree that you are personally responsible for the accuracy of the information and content you provide. You agree that Bold Existence will not be held liable for any disputes that may arise between you and a Member regarding the content you provide. You (Ambassador) agree that you will not share, sell, advertise, spam or misuse Members email addresses when they sign up to your courses and eLearning materials. You agree that you may only use Members’ email addresses who are enrolled in your courses and eLearning materials to notify and contact them regarding their enrolled courses and eLearning materials (e.g., in relation to assignments, quizzes, group discussions, course related questions). Any use of Members’ email addresses outside of courses and eLearning material related content is a violation in Privacy Policy and confidentiality. You agree Bold Existence will not be held liable or incur any losses if you violate the terms of this agreement and Privacy Policy. You (Ambassador) agree to not sell, spam, misuse, or share email addresses and names of Members who signed up to your courses and eLearning materials.
You (Member) agree that when you purchase, sign-up and use the courses, eLearning materials, groups and blogs on eaglehub.com.au created by Ambassadors, that you do so at your own risk. You (Member) also agree that your email address and name will be visible to Ambassadors of related courses and eLearning materials you enrol in. You agree that Bold Existence will not be held liable in the event of your email address being misused by such Ambassadors. You (Member) agree that if you do not wish for Ambassadors to have access to your email address and name, that you will not sign up to their course or eLearning material. You agree that Bold Existence will not be held responsible if Ambassadors violate the terms of this contract and misuse your email address and name. You agree that you provide your email address and name at your own discretion.
Limitations of Service
Bold Existence reserves the right to limit your use of the Services, including the number of your connections and your ability to contact other Members. Bold Existence reserves the right to restrict, suspend, or terminate your account if you breach this Contract or the law or are misusing the Services (e.g., violating any of the Community Guidelines). You agree that you will comply with all applicable laws, including, without limitation, privacy laws, intellectual property laws, anti-spam laws, export control laws, tax laws, and regulatory requirements; provide accurate information to us and keep it updated; use your real name on your profile; and use the Services in a respectful manner.
Other
You agree to not develop, support or use software, devices, scripts, robots or any other means or processes (including crawlers, browser plugins and add-ons or any other technology) to scrape the Services or otherwise copy profiles and other data from the Services; override any security feature or bypass or circumvent any access controls or use limits of the Service; post anything that contains software viruses, worms, or any other harmful code; Reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code for the Services or any related technology that is not open source; imply or state that you are affiliated with or endorsed by Bold Existence without our express consent (e.g., representing yourself as an accredited Bold Existence instructor); rent, lease, loan, trade, sell/re-sell or otherwise monetize the Services or related data or access to the same, without Bold Existence’s consent; use bots or other automated methods to access the Services, add or download contacts, send or redirect messages; monitor the Services’ availability, performance or functionality for any competitive purpose; engage in “framing,” “mirroring,” or otherwise simulating the appearance or function of the Services; overlay or otherwise modify the Services or their appearance (such as by inserting elements into the Services or removing, covering, or obscuring an advertisement included on the Services); Interfere with the operation of, or place an unreasonable load on, the Services (e.g., spam, denial of service attack, viruses, gaming algorithms); and/or violate the Community Guidelines or any additional terms concerning a specific Service that are provided when you sign up for or start using such Service.
You take full responsibility and risk for making any decision based on information on our website or in using our Services. You hereby agree to irrevocably release and waive any claims you may have now or in the future against us and we take no responsibility or liability whatsoever for any loss, damage or injury that may arise from any person acting on any statement or information contained on this website and all such liabilities are expressly disclaimed.
NO ADVICE DISCLAIMER
The information and any recommendations and advice contained on or through this website is for general information purposes only and is not meant to substitute individual personal and professional advice or application. Any advice, information and recommendations are to be used at your discretion.
PAYMENT AND REFUNDS
We try to ensure our services are provided with due care and skill, and we at all times abide by the Australian Consumer Protection legislation with respect to any refund. Any other refund is done in accordance with our refund policy and in our sole discretion (*see below). All fees are non-refundable and are non-transferrable between products or services unless, during the period in which you paid for a product or service through this website or our app, the product or service was not available. In this circumstance, a refund may be granted upon written request by email at [email protected], however, you acknowledge that we may refuse a request where we are able to provide the product or service to you through alternative means (such as email).
Courses and eLearning materials that are available within the EagleHub, require an active “EagleHub Subscription” or “Ambassador Subscription” subscription. When you purchase courses and eLearning materials within the EagleHub, these will remain accessible to you for the duration of your active “EagleHub Subscription” or “Ambassador Subscription” subscription. If you cancel your “EagleHub Subscription” or “Ambassador Subscription”, you will lose all access to courses and eLearning materials you purchased within the EagleHub. Refunds will not be issued for courses and eLearning materials purchased if you decide to discontinue your “EagleHub Subscription” or “Ambassador Subscription” subscription. The courses and eLearning materials within the EagleHub are part of the Services we provide at eaglehub.com.au.
Acceptance and continued access to our services and products are always subject to payment first being made by you. We make use of STRIPE and PayPal payment gateways. By using our services you agree that we will not be held liable for any loss you incur arising from your use of these payment methods unless caused by our fraud or the fraud of our employees.
If you buy any of our paid Services, you agree to pay us the applicable fees and taxes specific to the paid Services. Failure to pay these fees will result in the termination of your paid Services. Also, you agree that your purchase may be subject to foreign exchange fees or differences in prices based on location (e.g. exchange rates). We may store and continue billing your payment method (e.g. credit card) even after it has expired, to avoid interruptions in your Services and to use to pay other Services you may buy. If you purchase a subscription, your payment method automatically will be charged at the start of each subscription period for the fees and taxes applicable to that period. To avoid future charges, cancel before the renewal date. You can cancel your subscription from your account settings or by emailing us at [email protected].
*Available Refunds
We offer a seven-day-money back guarantee for first-time sign-ups to “EagleHub Subscription” and “Ambassador Subscription”. If within seven days of initial sign up you decide to discontinue our Services at eaglehub.com.au, you may receive a full refund on your “EagleHub Subscription” or “Ambassador Subscription” subscription by emailing us a refund request at [email protected]. You will need to provide your original sign-up email, username and name, for us to track your subscription and issue your refund and cancel your subscription. If you decide to discontinue our Services at eaglehub.com.au after seven days of initial sign-up, you will not be issued a refund, and your subscription will be cancelled. In the event of you cancelling your subscription and later decide to sign up again, you will not receive a refund. The seven-day money-back guarantee is for first-time sign-ups only, which allows customers to use our Services to see if our Services are the right fit for them. Please note, if you purchase any courses or eLearning materials during your initial seven-day sign-up period and decide to discontinue our Services, you will lose access to those courses and eLearning materials and will not receive a refund on purchases made for courses and eLearning materials. You will not be able to access any courses or eLearning materials outside of an active “EagleHub Subscription” or “Ambassador Subscription” subscription.
Ambassador Payouts
When you (Ambassadors only) create courses and eLearning materials on our EagleHub platform you reserve the right to make your courses and eLearning materials available for free or available for purchase to registered Members in the EagleHub. When you make your courses and eLearning materials available for purchase you agree that you will receive fifty percent from each successful purchase as commission. You agree that the other fifty percent from each successful purchase will be issued to Bold Existence (e.g., if you sell a course for ten dollars, you will receive five dollars and Bold Existence will receive five dollars). The fifty percent issued to Bold Existence is to cover taxes, overheads and other expenses that make it possible for you to sell your courses and eLearning materials in the EagleHub.
In order for you to receive your commissions you are required to have an active PayPal account. You agree that you are required to share your PayPal account email address with Bold Existence for payout purposes. If you do not have a PayPal account, you agree that you are required to sign up for one prior to selling courses and eLearning materials on our Services. You agree that if you fail to provide us with your PayPal email address, you will not receive commission payouts until you supply us with your PayPal email address. You agree that your PayPal email address must be provided to Bold Existence within thirty days of selling your first course or eLearning material. You agree that if you do not provide your PayPal email address within thirty days of your first sale, the entire sale amount will be issued to Bold Existence and you will not receive fifty percent commission from that sale or any sale thereafter until your PayPal email address is provided to Bold Existence for payouts.
You agree that Bold Existence will only use your PayPal email address for the express purpose of paying your commissions (see our Privacy Policy). You agree that we do not supply an alternative method for Payouts. If this should change in the future, we will update our Terms & Conditions and you will be notified via email. You agree that your payouts are issued by Bold Existence at the end of each calendar month. You agree that Bold Existence may hold your commissions for up to thirty days after a purchase has been made to ensure purchases have been cleared successfully and customers did not issue refunds on your courses or eLearning materials. You agree that if a customer should issue a refund for your course or eLearning material within thirty days of purchase, you will not receive any commissions for that purchase. You agree that commissions are only granted for successful purchases of your courses and eLearning materials.
COMPETITION AND CONSUMER ACT
For the purposes of Schedule 2 of the Australian Consumer Law, in particular Sections 51 to 53, 64 and 64A of Part 3-2, Division 1, Subdivision A of the Competition and Consumer Act 2010 (Cth), Boldexistence’s liability for any breach of a term of this agreement is limited to: the supplying of the goods or services to you again; the replacement of the goods; or the payment of the cost of having the goods or services supplied to you again.
It is an essential pre-condition to you using our website that you agree and accept that Bold Existence is not legally responsible for any loss or damage you might suffer related to your use of the website, whether from errors or from omissions in our documents or information, any goods or services we may offer or from any other use of the website. This includes your use or reliance on any third party content, links, comments, courses, eLearning materials or advertisements. Your use of, or reliance on, any information or materials on this website is entirely at your own risk, for which we shall not be liable.
It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific, personal requirements. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

Upon termination of our Services Members and Ambassadors maintain rights to further re-share content and information you shared through the Services. Any amounts owed by either party prior to termination remain owed after termination.
COMPLAINTS REGARDING CONTENT
We respect the intellectual property rights of others. We require that information posted by Members and Ambassadors be accurate and not in violation of the intellectual property rights or other rights of third parties. Complaints concerning content posted by our Members and Ambassadors can be reported using the “Report” function in the EagleHub, or emailed to [email protected].
WHOLE AGREEMENT
These terms and conditions and any agreement you sign for our Services, represent the whole agreement between you and us concerning your use and access to our website, Services and your use and access to the documents and information on it. No other term is to be included in this agreement except where it is required to be included by any legislation of the Commonwealth or any State or Territory. All implied terms except those implied by statute and which cannot be expressly excluded are hereby expressly excluded.
EXCLUSION OF UNENFORCEABLE TERMS
Where any clause or term above would by any applicable statute be illegal, void, or unenforceable in any State or Territory then such a clause shall not apply in that State or Territory and shall be deemed never to have been included in these terms and conditions in that State or Territory. COLLECTION OF CLIENT INFORMATION
In order to provide you with our services, we require the collection of personal information of members (“Members” and “Ambassadors”) which may include sensitive personal information. This may consist of name, address, contact details, date of birth, work history and other personal information (“Personal data”).
For all Personal Data we collect during provision of our Services and handling of Personal Data, we are committed to full compliance with all National Privacy Principles requirements. We ensure that our clients and anyone we pass the Personal Data onto, in order to provide our services is under a similar duty of compliance in accordance with the Privacy law.
To create an account you need to provide data including your name, username, email address, password, and payment (e.g., credit card) and billing information.
You have choices about the information you provide on your profile, such as your profile photo, cover photo, your age, your gender, your city or area, your birthday, your marital status, your education, your work experience, your employment details, and your skillsets. This information is not required. You don’t have to provide additional information on your profile; however, profile information helps you to get more from our Services. It’s your choice whether to include sensitive information on your profile and to make that public. Please do not post or add personal data to your profile that you would not want to be publicly available.
We collect personal data from you when you provide, post, or upload to our Services, such as filling out forms, forums, and surveys on our Services. When you connect your Zoom account (“Ambassadors” only), recordings of your Zoom account may be made available in groups if you so choose. Ambassadors don’t need to link their Zoom Accounts in groups. Ambassadors remain in full control of their connected Zoom account.
You and others may post content that includes information about you (as part of articles, posts, comments, videos) on our Services, as permitted by your settings, in notifications to others of mentions in the news feed.
We collect information about you when you send, receive or engage with messages in connection with our Services. For example we are notified when you act upon a connection request. HOW YOUR DATA IS USED
We use your data to authorize access to our Services and honour your settings. Our Services help you connect with others. Any data that you include on your profile and any content you post or social action (e.g., likes, follows, comments, shares) you take on our Services will be seen by others, consistent with your privacy settings. You can choose who you want to connect with. It is your choice whether to send a connection request, or allow another Member to become your connection. When you invite someone to connect with you, your invitation will include your network and basic profile information (e.g., name, profile photo). We will send invitation reminders to the person you invited. Your profile is fully visible to all Members and customers of our Services. All Members in the Eaglehub are visible and searchable by registered Members only (“Members” and “Ambassadors”). The data you provide on your profile can enhance your experience and connection. For example, if you fill out the section regarding whether you are looking for employment, then a Member who is an employer can find you using search settings in the EagleHub. Another example, if you select your marital status as single then other Members who are single can find you using search settings in the EagleHub. Profile details are optional and don’t need to be filled out. Profile details can also be made public or private. Our Services allow viewing and sharing information including through posts, likes, follows and comments:
Courses, eLearning, groups and forums
Our Ambassadors create courses and other eLearning content in the EagleHub. When you sign up to these, your profile details may be displayed to other members enrolled in that particular course or eLearning content. This is to allow collaboration and communication between Enrolees to discuss Course and eLearning content to enhance their knowledge and understanding through group and forum discussions. Your username, name, and email will be visible to Ambassadors when you enrol in their designate course or eLearning Content. Ambassadors will be able to email you directly using the email you provided when you registered. Ambassadors may at any point remove Members out of their groups and discussion forums. Ambassador’s profiles are displayed on their course pages.
Email and notifications
We will contact you through email, notices posted on our websites, messages to your EagleHub inbox, and other ways through our Services, including push notifications. We will send you messages about the availability of our Services, security, or other service-related issues. We also send messages about how to use our Services, network updates, reminders, and promotional messages from us. You may change your communication preferences at any time. Please be aware that you cannot opt out of receiving service messages from us, including security and legal notices.
We also enable communications between you and others through our Services, including for example invitations, groups and messages between connections.
Feedback, ratings and surveys
Feedback, ratings and surveys are conducted by us and others (Ambassadors) through our Services. You are not obligated to respond to feedback, ratings or surveys, and you have choices about the information you provide.

We use data (which can include your communications) to investigate, respond to and resolve complaints and for Service issues (e.g., bugs).

We use your data to produce and share insights that do not identify you. For example, we may use your data to generate statistics about our members and course enrolments,

We receive and store Personal Data and any personal information you enter on our website, provide physically or give us in any other way from time to time in a secure manner. We are committed to the protection of Personal Data and use all reasonable measures to ensure all Personal Data is kept secure at all times.
We ensure all physical and electronically held Personal Data is kept in a secure manner that is only accessible to persons who are authorized and who have agreed to the same or similar duty as prescribed by the Australian National Privacy Principles.

Information you have shared with others (e.g., through messages, updates or group posts) will remain visible after you close your account or delete the information from your own profile or message inbox, and we do not control data that other Members have copied out of our Services. Groups content and ratings or review content associated with closed accounts will show an unknown user as the source. Your profile may continue to be displayed in the services of others until they refresh their cache.

We will never disclose your personal details to a third party except the necessary information required by providers of products or services you have purchased. We use others to help us provide our Services (e.g., maintenance, analysis , payments, fraud detection, marketing and development). We may, however, use your information in a general sense, without any reference to your name, to create marketing statistics, identify user demands and to assist it in meeting customer needs generally.
